Please read these Terms of Use carefully before using Daymark. By downloading or using the app, you agree to these terms.

Acceptance of Terms

By accessing or using Daymark, developed and published by OFO Labs, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

License

OFO Labs grants you a limited, non-exclusive, non-transferable, revocable license to use Daymark for personal, non-commercial purposes on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions.

Your Content

Daymark stores information you enter about people in your life: names, dates, photos, gift ideas, and personal notes. You are responsible for that content, including having a reasonable basis to record details about other people. You agree not to use Daymark for any unlawful purpose, and not to misuse or reverse-engineer the app.

Data and Storage

Daymark stores all of your data locally on your device. OFO Labs has no access to this data and cannot recover it for you. We are not responsible for data loss resulting from device failure, app deletion, or iOS restores. Use the Export feature and keep your device backups enabled if you wish to preserve your data.

Reminders

Daymark schedules local notifications to remind you about upcoming dates. Delivery depends on iOS and on your device settings, including notification permission, Focus modes, and available system resources. Daymark is a convenience tool and not a guaranteed delivery service. You should not rely on it as the sole safeguard for time-critical obligations.

Purchases

Daymark is free to use with a limited number of people and reminder options. Daymark Pro is a single one-time, non-consumable in-app purchase that unlocks unlimited people, the earlier reminder options, the calendar view, and export and import.

  • Daymark Pro is not a subscription. There is no recurring charge and nothing to cancel.
  • The purchase is permanently tied to your Apple ID and can be restored on any device signed into the same account using Restore Purchases on the upgrade screen.
  • All payments are processed by Apple. Refunds are handled by Apple under Apple's refund policies.
  • Data you created before purchasing remains fully viewable at all times.

Intellectual Property

Daymark and its design, features, and functionality are owned by OFO Labs and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app.

Disclaimer of Warranties

Daymark is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. OFO Labs does not warrant that the app will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, OFO Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use Daymark, including any missed date, missed reminder, or missed occasion.

Changes to These Terms

We may update these Terms of Use from time to time. The current version will always be published here. Continued use of the app after an update constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of Germany, without regard to conflict of law provisions.
