Acceptance of Terms
By accessing or using Nightjar, developed and published by OFO Labs, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.
License
OFO Labs grants you a limited, non-exclusive, non-transferable, revocable license to use Nightjar on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions.
What Nightjar Does
Nightjar shuffles a deck of 78 tarot cards, lets you pick from them, shows you the cards with written meanings, and stores the readings you choose to keep along with your own notes. All of the artwork is drawn by the app itself, and all of the written meanings were written for this app.
What Nightjar Is Not
Nightjar is a deck and a notebook. It is for reflection and for entertainment.
- It does not tell you what is coming. Nothing in the app predicts events, and no card, spread position or summary is presented as a forecast.
- Nothing in it is medical, legal, financial or psychological advice. If you need that kind of help, please speak to someone qualified to give it.
- The patterns view counts the cards you have drawn and shows those counts beside what chance alone would produce. It is arithmetic about a small sample, not a meaning.
- What you make of a card is yours. The app offers a prompt to think with.
How the Shuffle Works
The deck is shuffled with a Fisher and Yates shuffle using your device's cryptographic random source. When you draw from the fan, the timing and position of your own touches are mixed in on top of that, which can only add to the randomness and never reduce it. The card under your finger is the card you receive. We describe this in the app because it is true, and because it is a claim worth being able to check.
Your Data
Nightjar stores what you enter on your device and nowhere else. There is no account and no server. You are responsible for anything you write in it, and for noting anything you want to keep before you delete the app. See the Privacy Policy for the detail.
Purchases
Nightjar is free to download and use. The free tier includes all 78 cards with both meanings, unlimited single and three card draws, and an unlimited journal. Nightjar Pro is a single non-consumable in-app purchase that unlocks the larger spreads, a custom spread builder, the patterns view, journal filtering and export, and alternate deck finishes. It is a one-time payment, not a subscription, and it does not expire. Nothing in the app is metered or counted.
Purchases are processed by Apple and governed by the Apple Media Services Terms and Conditions. Refunds are handled by Apple, not by OFO Labs.
Limitation of Liability
To the fullest extent permitted by law, OFO Labs is not liable for any loss, damage, cost or injury arising from the use of Nightjar or from any decision taken after reading a card. Nightjar is provided as is and without warranty of any kind.
Nothing in these terms limits liability that cannot lawfully be limited.
Changes
These terms may change. The date at the top will change with them, and continuing to use the app means accepting the revised terms.
